Terms of Service

These Terms of Service govern the use of both OGS products provided by Own Guide System LLP ("OGS"): the Smart Wallet hardware and software platform, and the OGS App available on Google Play.

1. Two products, two relationships: The Smart Wallet platform is provided to institutions and organisations ("Customers") who register for an account and issue Smart Wallets to their members. The OGS App is made available directly to individual end users ("Users") - such as parents, students, staff and transport teams - who create their own account, typically at a Customer institution's invitation.

2. For institutions (Smart Wallet): Customers are responsible for the accuracy of the information they upload and for managing access credentials issued to their administrators. Smart Wallets remain the property of OGS or the Customer as agreed in the applicable order form, and are provided "as is" with the warranty terms set out in that order form.

3. For app users (OGS App): You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that happens under your account. Do not use the app to impersonate another person or to access data you are not authorised to see.

4. Acceptable use: Neither product may be used to collect data unlawfully, to track individuals without appropriate notice or consent, or in any way that violates applicable law.

5. Service availability: OGS aims for high platform and app availability but does not guarantee uninterrupted service. Smart Wallet payments and access continue to function locally at the reader even during short network interruptions, with records syncing once connectivity resumes.

6. Fees and payment: Smart Wallet fees are set out in the applicable order form or subscription agreement between OGS and the Customer. The OGS App is currently free to download and use for individual users; this may change with notice.

7. Limitation of liability: To the maximum extent permitted by law, OGS's liability arising from use of either product is limited to the fees paid to OGS by the Customer (for Smart Wallet) in the twelve months preceding the claim, or, for App Users, to the maximum extent permitted by law given the app is provided free of charge.

8. Changes to these terms: We may update these terms from time to time; continued use of either product after an update constitutes acceptance of the revised terms.
